4. Consulting Services — General Terms
The Services offered by Bestari Group are provided subject to a separate written engagement agreement that will be issued to each Client before work begins. These Terms and Conditions govern the general relationship between Bestari Group and its Clients, but the engagement agreement takes precedence in the event of any inconsistency.
Key principles that apply to all engagements:
- The scope, deliverables, fees, and programme structure will be documented in writing before any work commences.
- Fees are invoiced in Malaysian Ringgit (RM). Published fees on this Website are inclusive of all sessions, preparation time, and deliverables described in the programme description, unless otherwise stated in the engagement agreement.
- Payment terms will be specified in the engagement agreement. Standard terms require an initial deposit upon signing, with the balance due on delivery of final outputs.
- Any work requested beyond the agreed programme scope will be discussed and agreed in writing before additional charges are incurred.
5. Cancellation and Rescheduling
Cancellations and rescheduling are governed by the terms set out in each engagement agreement. As a general principle:
- Session rescheduling with more than five working days' notice will ordinarily be accommodated without charge.
- Cancellation of an engagement after work has commenced will be subject to a fee reflecting the proportion of work already completed.
- Where Bestari Group is unable to fulfil a commitment due to circumstances within our control, we will offer a rescheduled date at no additional cost.
6. Confidentiality
All business information shared with Bestari Group in the course of an engagement — including but not limited to financial data, strategic plans, customer information, and internal documents — is treated as strictly confidential. We do not share, disclose, or reference client information in other engagements or publicly without prior written consent.
This commitment exists independently of any formal non-disclosure agreement and is a standing professional obligation maintained by all members of the consulting team.
7. Limitations of Liability
Bestari Group provides consulting advice and deliverables to the best of our professional ability and judgment. However, we do not warrant specific business outcomes as a result of any engagement. The advice provided is advisory in nature — decisions to act on recommendations remain with the Client.
To the extent permitted by Malaysian law, Bestari Group's total liability in connection with any engagement shall not exceed the total fees paid by the Client for that engagement. We shall not be liable for indirect, consequential, or loss-of-profit damages arising from the use of or reliance on our services or this Website.
Nothing in these Terms limits liability for fraud, gross negligence, or liability that cannot be lawfully excluded.
8. Disclaimer of Warranties
The Website is provided on an "as is" and "as available" basis without warranty of any kind, express or implied. We make no representations that the Website will be uninterrupted, error-free, or free of harmful components. Information on the Website is subject to change without notice.
